Release of Liability, Waiver & Assumption of Risk

1. Voluntary participation & assumption of risk

I am voluntarily requesting aesthetic, wellness, and/or medical-spa services to be performed at a location of my choosing. I understand that all such services carry inherent risks, which may include but are not limited to: bruising, swelling, redness, infection, allergic reaction, asymmetry, bleeding, discomfort, scarring, nerve irritation, and outcomes that differ from my expectations.

I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation.

2. No guarantee of results

I understand that the practice of medicine and aesthetics is not an exact science, and that no guarantees have been or can be made to me regarding results. Individual results vary, and additional treatments or touch-ups may be necessary at additional cost.

3. Truthful disclosure

I certify that the health, medical, and intake information I provide is true and complete to the best of my knowledge. I understand that withholding information may be dangerous to my health and may result in my provider declining to perform a service. I agree to notify my provider of any changes to my health before treatment begins.

4. Release & waiver of claims

To the fullest extent permitted by law, I release, waive, and discharge Habit, THNK, the treating provider, and their respective owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury that may be sustained in connection with the services — except for claims arising from gross negligence or willful misconduct.

I agree to indemnify and hold Habit harmless from any claims brought by me or on my behalf.

5. Mobile / in-home services

I understand that services are performed at a location I designate. I represent that I have the authority to permit the provider to enter that location, that it is reasonably safe and sanitary, and that I will provide a clean, well-lit area appropriate for the service.

I agree to treat my provider with respect and to maintain a safe, professional environment. Harassment, intoxication that interferes with care, or any unsafe condition entitles the provider to end the visit immediately and in full.

6. Media consent (optional)

Unless I opt out in writing, I grant Habit permission to use before/after or event photographs for quality, training, or marketing purposes, without compensation. I may revoke this consent for future use at any time.

7. Financial responsibility & cancellation

I authorize Habit to charge my payment method for booked services, deposits, travel fees, and any balance due. Deposits and cancellation terms are governed by each provider's policy and Habit's House Party policy, as applicable.

8. Governing terms

This agreement is governed by the laws of the State of Utah. If any provision is held unenforceable, the remaining provisions stay in effect. This document supersedes any prior verbal or written disclosures on the same subject.
